Terms of Service

Please read these terms carefully before using Nyra Bot.

1. Acceptance of Terms

Welcome to Nyra Bot ("the Service"). By accessing our website (nyrabot.de), using our Discord bot, integrating our APIs, or subscribing to our Premium packages, you ("the User") agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Nyra Bot regarding your use of the Service. If you do not agree with any part of these terms, you are prohibited from using or accessing the Service.

2. Service Description & License

Nyra Bot provides automated management tools, analytics, and automation features for ARK: Survival Evolved and ARK: Survival Ascended game servers. We grant you a personal, non-exclusive, non-transferable, revocable, limited license to use the Service strictly in accordance with your chosen subscription level and these Terms.

  • Prohibited Use: You may not use the Service for any unlawful purpose, to distribute malware, or in any way that violates the Discord Developer Terms of Service or the EULA of the respective game developers (Studio Wildcard).
  • Account Responsibility: You are responsible for maintaining the security of your Discord account and any integrated API keys.
  • Termination: This license shall automatically terminate if you violate any of these restrictions and may be terminated by Nyra Bot at any time for any reason.

3. User Conduct & Prohibited Activities

To ensure a fair and stable environment for all users, you agree not to engage in the following prohibited activities:

  • Attempt to reverse-engineer, decompile, or extract the source code of the Bot or its associated APIs.
  • Use automated systems (bots, spiders) to scrape data from the Service without explicit authorization.
  • Bypass or attempt to bypass any security measures, rate limiters, or subscription gates.
  • Use the Service to harass, threaten, or impersonate other users or administrative staff.
  • Utilize Nyra Bot features to facilitate the sale of in-game items for real-world currency (RMT) in violation of game developer policies.

4. Subscriptions, Payments & Virtual Goods

  • Recurring Billing: Premium features require a valid subscription. By subscribing, you authorize our payment processors (PayPal) to charge the applicable fees on a recurring basis (Monthly or Yearly).
  • Price Changes: We reserve the right to adjust subscription prices. Existing subscribers will be notified in advance.
  • Cancellations: You can cancel your subscription at any time via your PayPal dashboard or by contacting our support. Your access will remain active until the current billing cycle expires.
  • Refund Policy: Due to the digital nature of the services and immediate provision of access, all transactions are generally non-refundable. Exceptional refunds (e.g., accidental double-billing) are handled on a case-by-case basis via our Discord ticketing system.
  • Chargebacks: Unauthorized chargebacks or payment disputes will result in an immediate and permanent ban of your Discord account and all associated servers from the Nyra ecosystem.

5. Data & Game Progress

Nyra Bot interacts with your game server data to provide management features. While we strive for 100% reliability, we do not guarantee the integrity of game data. You are responsible for maintaining regular backups of your own game server files. Nyra Bot is not liable for data loss, server wipes, or map corruption resulting from bot malfunctions or configuration errors.

6. Intellectual Property

All content, branding, code, and UI elements provided via the Service are the exclusive property of Nyra Bot. Our trademarks, logos, and "⚡" branding may not be used in connection with any third-party product without prior written consent.

7. Limitation of Liability

To the maximum extent permitted by law, Nyra Bot shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service. This includes, but is not limited to, loss of revenue, community reputation, or game-related assets.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE". We provide no warranty, express or implied, regarding the accuracy, reliability, or continuous availability of the Service. Access may be interrupted due to maintenance, Discord API outages, or technical failures beyond our control.

9. Governing Law & Jurisdiction

These Terms are governed by the laws of Germany. Any legal disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts in Germany.

10. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time. We also reserve the right to update these Terms. Changes will be announced on our official Discord server. Continued use of the Service after changes constitute acceptance of the new Terms.
